Only those not yet time-barred
The Tax Agency has four years to review a return, counting from the end of the filing period. In September 2026, tax years 2022 to 2025 are, as a rule, still open.
If you did not declare your crypto, regularizing your position before the Spanish Tax Agency (Hacienda) writes to you makes a big difference: you pay a surcharge instead of a penalty. We explain which years you can correct, what it costs and how to rebuild transactions from years ago.

What makes the difference is a prior request (requerimiento previo): if you file before the Tax Agency takes action, you pay a surcharge and there is no penalty.
| Situation | What you pay on top of the tax | Legal basis |
|---|---|---|
| You file within 12 months after the deadline | A surcharge of 1% plus 1% for each full month of delay. No interest and no penalty. | LGT Art. 27(2) |
| You file after more than 12 months | A 15% surcharge plus late-payment interest from month 13. No penalty. | LGT Art. 27(2) |
| You pay the surcharge and the tax debt on time | The surcharge is reduced by 25%. | LGT Art. 27(5) |
| The Tax Agency finds you first | The tax due, late-payment interest and a penalty that can range from 50% to 150% of the unpaid tax. | LGT Arts. 191 et seq. |
Regularizing is not just filing a return: it means rebuilding years of transactions with an approach that will hold up in a tax review.
The Tax Agency has four years to review a return, counting from the end of the filing period. In September 2026, tax years 2022 to 2025 are, as a rule, still open.
Sales for euros, crypto-to-crypto swaps, staking and payments made in crypto are all taxable. Transfers between your own wallets are not.
If you already filed that year’s income tax return, you amend it in Renta WEB (a corrective self-assessment, or autoliquidación rectificativa, from the 2023 return onward; a supplementary return, or complementaria, for earlier years). If you did not file it, you file it late.
Has the Tax Agency already written to you? Then this is no longer a voluntary regularization: read how to respond to a crypto information request.
For guidance only, for returns subject to the usual income tax campaign deadline. The limitation period is interrupted by any Tax Agency action concerning that year.
| Tax year | Income tax return deadline | Becomes time-barred, as a rule |
|---|---|---|
| 2021 | June 30, 2022 | Time-barred since July 2026, unless interrupted. |
| 2022 | June 30, 2023 | June 2027 |
| 2023 | July 1, 2024 | July 2028 |
| 2024 | June 30, 2025 | June 2029 |
| 2025 | June 30, 2026 | June 2030 |
Watch out for unexplained wealth: the Tax Agency can treat it as an unjustified capital gain in the year it discovers it, unless you prove you already owned it before (Article 39 of the Personal Income Tax Law, LIRPF). That is why it is worth documenting how long you have held your crypto.
The hard part of regularizing late is not the form: it is finding the data. These are the sources used when histories are missing.
Active exchangesMost exchanges let you download years of transactions. This is the main source and the first one to request.
Closed exchangesConfirmation emails for purchases and withdrawals, and the bank statements showing your payments to the exchange.
On-chainOn-chain transactions are still there: with your addresses, dates, amounts and paths can be rebuilt.
GapsIf you cannot prove what you paid, the risk is that the cost is not accepted and almost the entire sale price is taxed. It has to be documented with all the evidence available.
What should I do?Regularize with a surcharge.
Respond on time with the supporting file.
A report that documents them.
The gain or loss on each sale, in its own year.
Losses are declared too and can offset gains.
Each swap, even if you never cashed out to euros.
This is the most common mistake: swaps are taxable (DGT, binding ruling V0999-18).
The income, at its value when you received it.
That value becomes your purchase cost when you later sell.
Form 721 for each year in which you exceeded the threshold.
It is an information return: no tax is payable, but there is a fine for not filing it.
Usually, nothing for income tax (IRPF).
Check Form 721 and wealth tax. See when to declare.
They can turn a regularization into a tax review.
We rebuild your transactions, calculate each year and prepare the regularization with the file that supports it, before a request arrives.
Yes. As long as the tax year is not time-barred and the Tax Agency has not notified you of anything about it, you can file or correct that year’s return. You will pay a surcharge, but there will be no penalty.
1% plus another 1% for each full month of delay if you file within 12 months after the deadline. After that year, 15% plus late-payment interest. The surcharge is reduced by 25% if you pay on time.
Those that are not yet time-barred. The Tax Agency has four years to review a return, counting from the end of the filing period: in September 2026, tax years 2022 to 2025 are, as a rule, still open.
Then it is no longer voluntary: if the letter concerns that tax and that year, you cannot rely on the surcharge. You have to respond within the deadline. Read how to respond to a crypto information request.
Yes. According to the Directorate General of Taxes (DGT), exchanging one crypto for another is a swap (permuta) that generates a capital gain or loss, even if you never cashed out to euros.
You can file it late. If you do so without a prior request, the fine for filing an information return late is halved. More information on Form 721.
It is rebuilt from emails, bank statements and on-chain traceability. If the purchase price is missing, it has to be documented with all the evidence available so that the cost is accepted.
If the tax evaded for one tax and one year exceeds €120,000, it can be a tax crime (Article 305 of the Criminal Code). A full regularization before the Tax Agency takes action also has effects in that area.
The law favors those who correct things on their own and is harsher on those who wait to be found out.
The Tax Agency has data: Forms 172 and 173, your Form 721 returns and, from 2027, the DAC8 information exchange.
Banks ask questions: if you move undeclared crypto money into your bank account, you will have to explain a source that does not match your income tax returns.
Time is running: every month of delay increases the surcharge, up to 15%.
Filing late without a prior request means a surcharge that rules out penalties.
Those who regularize voluntarily are not liable for the offenses committed in their original returns.
Wealth with no proven source can be taxed as an unjustified capital gain, in the general tax base.
Tell us which years and which transactions you did not declare: we will tell you how to regularize and what it would cost, before a letter arrives.
If you did not declare your crypto, you can regularize by filing or correcting the return for each tax year that is not yet time-barred. If you do so before the Tax Agency notifies you of any action concerning that tax and that year, you pay a surcharge under Article 27 of the General Tax Law and there is no penalty (Article 179(3)).
The surcharge is 1% plus 1% for each full month of delay during the first 12 months, and 15% plus late-payment interest after that. It is reduced by 25% if you pay on time. If it is the Tax Agency that detects it, a penalty of 50% to 150% of the unpaid tax is added. We explain this in penalties for not declaring crypto.
You must declare sales for euros, crypto-to-crypto swaps and income such as staking, each in its own year and using the FIFO method. The Tax Agency has four years from the end of the filing period: in September 2026, tax years 2022 to 2025 are, as a rule, still open.
If your crypto on foreign platforms exceeded €50,000 on any December 31, you must also file the missing Form 721; filed late and without a prior request, the fine is halved. Also check whether wealth tax (Impuesto sobre el Patrimonio) applied to you in your autonomous community.
